Terms and Conditions

Article 1: Preamble

These terms of sale are concluded, on the one hand, by the company "Awale Trading et Services ATS SAS" whose registered office is located at 4, Almadies Zone 12 BP 29425 Dakar Senegal, registered under the NINEA Number 005268497 Trade Register Number 19306 as well as its subsidiary in France registered under the SIRET Number 91476072300025, hereinafter referred to as "the seller" and, on the other hand, by any natural or legal person wishing to make a purchase via the seller's website www.madinaf.com, hereinafter referred to as "the buyer".

Article 2: Purpose

These terms of sale aim to define the contractual relationship between the seller and the buyer as well as the conditions applicable to any purchase made through the seller's website, whether the buyer is a professional or a consumer.

The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these terms of sale.

These terms of sale will prevail over any other general or specific conditions not expressly agreed to by the seller.

The seller reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.

Article 3: Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the seller's website. Each product is accompanied by a description provided by the supplier.

The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the offered product, especially regarding colors.

These products and services are offered within the limits of available stocks. If, despite its efforts, all or part of the items are unavailable, the seller will inform the buyer by email as soon as possible and offer the buyer the option to wait or cancel the order for the unavailable items at no cost. Available items will be delivered normally.

Article 4: Prices

The prices of the products and services displayed on the site are indicated in euros, all taxes included (VAT and other applicable taxes). It is also possible for the buyer to choose the option to display product prices in dollars, CFA francs, or euros. The seller reserves the right to modify its prices at any time. However, the prices applicable to the order are those in effect at the time of confirmation of the order. The indicated prices do not include order processing, transportation, and delivery costs, provided that these details are given during the order process and in the order summary before submission.

Article 5: Geographical areas

The online sale of products and services presented on the seller's site is available to all buyers regardless of their country of residence (deliveries to all geographical areas worldwide).

Article 6: Orders

The buyer, who wishes to purchase a product or service, must:

• fill out the identification form on which they will provide all the requested details or identify themselves if they already have a customer account on the site www.madinaf.com;
• fill out the online order form by selecting the products or services;
• choose the payment method;
• choose the delivery option;
• validate their order after verifying it;
• make the payment under the specified conditions;
• confirm the order.

The confirmation of the order implies acceptance of these terms of sale, acknowledgment of having perfect knowledge of them, and waiver of the right to invoke their own purchase conditions or other conditions.

All the provided data and the recorded confirmation will be proof of the transaction. The confirmation will be equivalent to a signature and acceptance of the operations carried out. The seller will communicate by email the confirmation of the registered order and payment.

Article 7: Right of withdrawal

In accordance with the law, the consumer has the right to notify the seller that they are withdrawing from their purchase, without penalty and without giving any reason, within 14 working days from the day after the delivery of the product or the conclusion of the service contract. This right of withdrawal does not apply to professional buyers. Within this period, the consumer must notify their intention to withdraw by email via the platform www.madinaf.com option "return request", at their own expense and risk, the delivered product to the seller. The products must be returned in their original packaging, undamaged, accompanied by all their accessories, the user manual, and the original invoice/delivery note. The returned products must not have been unpacked, unsealed, or used in any way. Incomplete, damaged, or soiled goods by the customer will not be taken back. Within 30 days, after acceptance of the return of the goods, the seller undertakes to refund any payment, except for shipping costs. Unless otherwise agreed, the consumer cannot exercise the right of withdrawal for contracts:

• for the provision of services whose execution has begun with the consumer's agreement before the end of the withdrawal period;
• for the supply of products made according to the consumer's specifications or clearly personalized or which, due to their nature, cannot be reshipped or are likely to deteriorate or expire quickly;

Article 8: Payment methods

Payment is made by credit card, Visa, Mastercard, American Express, or Maestro. It is also possible for the buyer to place their order by choosing the "Phone Ordering" option, which allows the use of other payment methods such as Mobile Money, Money Transfer, or cash on delivery (cash on delivery is only offered in certain countries). The ordered items remain our exclusive property until full payment of the order by the buyer.

Article 9: Deliveries

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. The goods are transported at the seller's risk until the delivery of the goods to the delivery address specified by the buyer. From that moment, the buyer assumes the risks alone. Delivery times are given as an indication; if they exceed thirty days from the order, the sales contract may be terminated, and the buyer refunded.

Article 10: Warranty

With regard to consumers, the seller guarantees the products it sells and the services it provides in accordance with the law on consumer protection in the event of the sale of consumer goods. In the event of non-compliance of a product sold found within 2 months of the delivery of the goods, the consumer must notify the seller as soon as possible in a precise manner by registered letter or email.

This warranty only covers conformity defects existing at the time of delivery of the goods. Defects or damage due to misuse, such as oxidation, fall or shock, negligence, and wear, are not covered by the warranty. Similarly, repairs carried out by unauthorized technicians by the supplier will result in the cancellation of the warranty. The invoice or delivery note serves as a warranty certificate and must be kept by the consumer and produced in original. If the product is used for non-private purposes, the limited warranty conditions of the manufacturer/supplier apply.

Article 11: Liability

The seller, in the online sales process, is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems. The data provided on the site is given in good faith. The links offered to the sites of manufacturers and/or partners are given for information purposes. The seller cannot be held responsible for information from these sites.

Article 12: Intellectual property

All elements of the seller's site are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether they are software, visual, or sound. Any simple or hypertext link is strictly prohibited without the prior express written consent of the seller.

Article 13: Personal data

All personal data necessary for the processing of an order is kept by the seller or its collaborators and may be transmitted to companies with which the seller – or its suppliers – collaborates, when such communication is necessary for the processing of the order. The user also authorizes the seller to use this data to establish statistics to improve its site, the goods, and the service it offers. This information may also be used to allow the dissemination, by any means of communication, of information relating to the seller's commercial activities to its customers. The seller finally keeps personal data to facilitate subsequent orders. The seller undertakes not to disclose the information it holds to another company or another company.

Article 14: Proof

The parties accept, in the context of their relations, electronic means of proof (for example: email, computer backups, ...).

Article 15: Dispute resolution

These online sales terms are subject to Senegalese law.
